The Board of Adjustment is a five-member board that meets the last Tuesday night of the month and is responsible for making decisions regarding Variance and Special Exception to the Zoning Code. Typical cases include decisions regarding variance to building setbacks and lot size and special exception to the uses allowed in particular zoning districts
The Board of Adjustment shall have the power to hear appeals from the determinations of the City Manager or his designee in enforcing the zoning code, to grant special exceptions, to grant variances, and the make interpretations of the zoning map and text.
Special Exceptions and Variances are processed through the Board of Adjustment and require a minimum of 10 days public notification. Staff will place the notice in a local paper and mail notification to owners of land within 300' of the subject property. The applicant is required to provide a 300' ownership list certified by an abstracting company. Typical processing time is approximately 30 days. The application fee is $30; costs for the ownership list, newspaper publication and mailing vary but typically run in the range of $150.
