ORDINANCE 854 AMENDING PART 7 CHAPTER 5

DISCUSSION AND POSSIBLE ACTION ON THE ADOPTION OF ORDINANCE 854, AN ORDINANCE OF THE CITY OF COWETA, OKLAHOMA, ADOPTING NEW LAW BY AMENDING PART 7, FINANCE AND TAXATION, CHAPTER 5, USE TAX, OF THE CODE OF ORDINANCES OF THE CITY OF COWETA, OKLAHOMA, SPECIFICALLY AMENDING SECTION 5-503 BY INCREASING THE RATE OF TAX TO FOUR PERCENT (4%) OF THE PURCHASE PRICE ON STORAGE, USE OR OTHER CONSUMPTION OF TANGIBLE, PERSONAL PROPERTY IN THE CITY OF COWETA, OKLAHOMA, AMENDING SECTION 5-504, PURPOSE OF REVENUES, TO PROVIDE THAT THE ONE-PERCENT INCREASE (1%) IN THE USE TAX SHALL BE UTILIZED SOLELY FOR PURPOSES SET FORTH IN SECTION 7 OF THE CITY OF COWETA, OKLAHOMA SPECIAL SALES TAX ORDINANCE NO. 850, REPEALING ALL PRIOR ORDINANCES TO THE CONTRARY, PROVIDING FOR SEVERABILITY AND DECLARING AN EMERGENCY. DISCUSSION AND POSSIBLE ACTION ON THE ADOPTION OF RESOLUTION 2022-05, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COWETA, OKLAHOMA, APPROVING AN EQUIPMENT LEASE PURCHASE AGREEMENT WITH RCB BANK FOR FIRE EQUIPMENT; ESTABLISHING THE CITY’S REASONABLE EXPECTATION WITH RESPECT TO THE ISSUANCE OF NON-TAXABLE OBLIGATIONS BY THE CITY IN CALENDAR YEAR 2022, AND DESIGNATING THE LEASE-PURCHASE AGREEMENT AS A NON-QUALIFIED TAXABLE OBLIGATION; AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATED TO THE ACQUISITION AND/OR LEASE PURCHASE OF SUCH EQUIPMENT. RESOLUTION 2022-06

DISCUSSION AND POSSIBLE ACTION ON THE ADOPTION OF RESOLUTION 2022-06 A RESOLUTION OF THE CITY OF COWETA, OKLAHOMA (THE “CITY”) APPROVING THE INCURRENCE OF INDEBTEDNESS BY THE COWETA PUBLIC WORKS AUTHORITY (THE “AUTHORITY”) ISSUING ITS SALES TAX REVENUE NOTE, SERIES 2022 (THE “NOTE”); PROVIDING THAT THE ORGANIZATIONAL DOCUMENT CREATING THE AUTHORITY IS SUBJECT TO THE PROVISIONS OF THE NOTE INDENTURE, AUTHORIZING THE ISSUANCE OF SAID NOTE; WAIVING COMPETITIVE BIDDING WITH RESPECT TO THE SALE OF SAID NOTE AND APPROVING THE PROCEEDINGS OF THE AUTHORITY PERTAINING TO THE SALE OF SAID NOTE; APPROVING AND AUTHORIZING A SALES TAX AGREEMENT BY AND BETWEEN THE CITY AND THE AUTHORITY PERTAINING TO THE YEAR-TO-YEAR PLEDGE OF CERTAIN SALES AND USE TAX REVENUE; AND CONTAINING OTHER PROVISIONS RELATING THERETO.
